Moveout · Security deposit

How long does a landlord in Alaska have to return a security deposit?

Fourteen days applies only when the landlord or tenant gave notice of termination complying with AS 34.03.290 AND the landlord deducts nothing; the same subsection gives the landlord thirty days if costs are deducted for damages caused by the tenant's noncompliance. If the tenant did not give notice complying with AS 34.03.290, the deadline is thirty days after the tenancy is terminated, possession is delivered, or the landlord becomes aware the unit is abandoned. The clock runs from termination of the tenancy and delivery of possession, and the landlord discharges the duty by mailing to the tenant's last known address.

In plain terms, the statute says

If the landlord wilfully fails to comply with the itemize-and-refund duty of subsection (b), the tenant may recover an amount not to exceed twice the actual amount withheld, so the remedy requires a finding of wilfulness and is a ceiling rather than an automatic award. The section does not preclude either side from recovering other damages under the chapter.

Who this covers

Subsection (a) says 'This section does not apply to rental units where the rent exceeds $2,000 a month.' On its face that limits the whole section, but it sits in the subsection capping the deposit at two months' rent, so who it reaches is not settled.
