Terms of service
These terms govern your use of Moveout. Using the site means you accept them. If you do not, do not use the site.
What Moveout is
Moveout is an informational self-help service. It takes facts you confirm about your own tenancy, applies published statutory rules to them, and shows you the result. If you choose, it will assemble those facts into a demand letter, show it to you, and mail it in your name to the landlord you identify, after you have reviewed and signed it.
What Moveout is not
Moveout is not a law firm and does not give legal advice. Using Moveout does not create a lawyer–client relationship, and nothing on this site is a substitute for advice from a lawyer licensed in your state. No one here is your attorney, your agent of record, or your representative in any proceeding. We do not select your legal strategy, decide what your facts are, evaluate the strength of your case, or tell you whether to send anything. You may consult a lawyer at any point, and for anything beyond a straightforward deposit demand you should.
You are the author and the sender
Every letter Moveout produces is your letter. You supply the facts, you review the finished document, you sign it with your own name, and you instruct us to mail it. Moveout assembles, formats and mails on your instruction. You are responsible for the accuracy of what you tell us, and you may stop at any point before anything is sent.
No guarantee of outcome
We do not promise that a landlord will respond, that any money will be returned, that any figure shown will be awarded, or that any deadline we compute will be treated as decisive by a court. Statutory penalties are typically discretionary and depend on findings a court makes; a number on this site is arithmetic on your facts, not a prediction. The service, and everything on it, is provided as is, without warranties of any kind to the extent the law allows.
Eligibility and acceptable use
You must be 18 or older and be the tenant on the tenancy you are asking about. Do not use Moveout to send anything false, to harass anyone, or on someone else’s behalf without their authority. We may suspend an account that does.
Payment, refunds and cancellation
The calculator and the result are free. Mailing a certified demand letter is a one-time paid service. We show you its price and the finished letter before you pay, and you pay on our payment processor's secure checkout page, entering your card details directly with them. You are charged once, when you complete that payment. If you ask us to cancel before the letter is mailed, or if we cannot mail a letter you paid for, we refund what you paid. If a mailed letter fails through our error, you get a free re-send or, at your choice, a refund. A letter that reaches the landlord is not refundable for the outcome, because the outcome is not ours to control.
Your content
Your facts, documents and photos stay yours. You grant us only the permission needed to run the service for you: to store your material, to render it into the document you request, and to transmit that document when you instruct us to. We claim no other rights in it.
Limitation of liability
To the extent the law allows, Moveout is not liable for indirect, incidental or consequential damages, or for lost recovery on a deposit claim. Our total liability for any claim relating to the service is limited to the amount you paid us for the service giving rise to it. Some states do not allow these limits, and where that is so they do not apply to you.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of them is subject to the exclusive jurisdiction of the state and federal courts located in California. Nothing here waives a right you have as a consumer that cannot be waived by agreement.
Changes and contact
We may change these terms; the revision date below changes with them, and continuing to use the service after a change means you accept it.
A contact address for ask about these terms is not configured for this deployment of the site.
