Moveout · Security deposit

How long does a landlord in Wyoming have to return a security deposit?

Three moving parts. The base deadline is thirty days after termination of the rental agreement, OR fifteen days after receipt of the renter's new mailing address, whichever is later — so a renter who supplies an address late pushes the date out rather than losing the right. Separately, the number itself forks on a fact: if there is damage to the residential rental unit, § 1-21-1208(a) extends the period by another thirty days, giving an outer bound of sixty days. The renter in turn must notify the owner or designated agent within thirty days of termination of the location where payment and notice may be made or mailed.

In plain terms, the statute says

The remedy is gated on unreasonableness rather than being strict: if the owner or the owner's agent unreasonably fails to comply with subsection (a) or (b), the renter may recover the full deposit and court costs, and the statute sets no multiple of the amount withheld and no statutory dollar penalty. The provision cuts both ways — if the owner prevails and the court finds the renter acted unreasonably in bringing the action, the owner may be awarded court costs.

Who this covers

Wyo. Stat. Ann. § 1-21-1201(a)(iv) defines 'residential rental unit' as the renter's PRINCIPAL PLACE OF RESIDENCE and expressly excludes a mobile home lot and recreational property rented on an occasional basis, so second homes, vacation rentals and mobile home lot rentals fall outside the article.
